SHORTFALL IN QUALIFYING SERVICE FOR GRANT OF MINIMUM PENSION SHALL BE TAKEN FROM GDS PERIOD OF EMPLOYMENT

AN HISTORICAL DECISION

As per the Pension rules, those who are not possessing 9 years 9 months service, they are not entitled for pension. Several GDS comrades who were promoted to Group D cadre could not avail the pension due to short fall of minimum service prescribed for pension.

The CAT, Madras in its O.A. No. 1264 of 2001 in the case of Sri. M. R. Palanisamy Vs. Department of Posts directed the department" to consider a scheme by giving weightage for certain percentage of service rendered as and ED Agent for reckoning the same as a qualifying service for purposes of pension in respect of persons who get absorbed or promoted against regular Group D posts in the department which would enable such employees to get the minimum pension."

The department has moved to High Court. The High court, Chennai vide its WP No. 45465 of 2007 has uphold the decisions of the CAT Chennai by sanctioning atleast the minimum pension by making up the shortfall in service. Aggrieved by the decision, the Department has filed a special leave petition in Supreme Court under CC 13829/2008.

The Supreme Court has dismissed the SLP on 17.10.2008 and the department has sought the approval for implementation of the decision from the DOPT. Accordingly the DOPT has caused approval and the department vide its letter No. 99-3/08-Pen dt. 09.10.2009 communicated the decision which is furnished interalia: -

I am directed to refer to your office letter DO letter No. APA/86-237/2002 dated 24.03.2009 regarding the abovementioned subject.

Approval of Dept. of Pension & Pensioner welfare is hereby conveyed for implementation of the Order/Judgment dated 04.10.2007 of High court of Chennai in WP No. 45465 of 2007 arising out of CAT Chennai OA No. 1262 of 2001 as a special relief to Shri. M. R. Palaniswamy, Retired Group 'C', Tiruppur, by sanctioning at least the minimum pension by making up the shortfall in service to the extent of shortfall by taking into account the EDA period of employment.

This decision is a historical one. There may be many comrades in many circles who could not receive pension due to shortfall in qualifying service. All our Divisional/Branch Secretaries are requested to guide those comrades to file a case in their respective CATS at once and assist them. The copy of the CAT, Supreme Court judgment and department orders about the implementation of the judgment had already been sent to all CHQ office bearers/Circle Secretaries from whom you can collect the copies.

All the existing EDSOs will be downgraded as BOs before 28.2.2010 as there is no much distinction between the functioning of the EDSOs and BOs

Directorate has issued orders vide letter dated 14.1.2010 to take action for downgrading all EDSOs as BOs before 28.2.2010 after considering the recommendations given by the One-man committee chaired by Shri R.S. Nataraja Murti.

Present incumbents holding the post of GDS SPM wil be given protection in the TRCA scale of Rs 4575-85-7125 corresponding to 5 hrs/125 Points. The downgraded EDSO will function with the establishment of GDS SPM, GDS MD/MC depending on the justification for such a post.

It has also been ordered that if there is justification for upgradation into Departmental Sub Office, it can be upgraded by utilizing any surplus post of PA.

NREGS INCENTIVE SCHEME ORDERED BY DOP

DEPARTMENT OF POSTS ISSUED AN ORDER ON INCENTIVE SCHEME FOR NREGS

INCENTIVE WILL BE PAID FOR OPENING NREGS ACCOUNTS; FOR MAKING PAYMENTS; AND FOR LEDGER ENTRIES.

MAXIMUM INCENTIVE PAYABLE TO GDS BPMs WILL BE LIMITED TO THE BASIC TRCA + DA OF THE RESPECTIVE GDS BPM.

MAXIMUM INCENTIVE PAYABLE TO REGULAR EMPLOYEES WILL BE REGULATED UNDER THE EXISTING DOPT/GOVT INSTRUCTIONS AND THE EXISTING ANNUAL CEILING.

Discussed the issue of Immediate Relief of all AAO Promotees and Pointed out the situation arising out of interpretation from some circles awaiting endorsement of second list released by DOT.

Action will be taken by DoP to endorse the list to facilitate immediate relief of AAO Promotees.
NFPE had already written to Secretary [P] requesting AAO Promotion for IPOs/ASPOs in the list - IPOs/ASPOs Association also represented - Now we are trying to meet the Secretary [P] for their inclusion.
Casual Labourers both full time and part time / contingent wage revision file has been returned by the MOF with the direction to send the same to DOPT - Fiel is expected to go to DOPT shortly - Positive early orders not appear in sight - NFPE will discuss with the Postal JCA for Action Programme on this issue.
NFPE & GDS Union have some discussion on GDS issues - Meanwhile NFPE has received the reply of Department denying any reconsideration of BPM work load norms on cash handling - It was decided between NFPE & GDS Union to discuss with the FNPO Federation for exploring the possibility of a Joint Programme of Action.
Confederation National Secretariat has met on 18/01/2010 - Decided to strengthen the Confederation by attending to the task of formation of State Committees of Confederation in all States.

NFPE DEMANDS ENHANCEMENT OF GRADE PAY TO HSG-II/BCR & HSG-I ON PAR WITH IPO/ASPOS

DEPARTMENT IS POSITIVELY RECOMMENDING TO MINISTRY OF FINANCE TO ENHANCE THE GRADE PAY FOR IPOs & ASPOs & GROUP 'B' TO 4600/-; 4800/- & 5400/- RESPECTIVELY.

NFPE HAS DEMANDED TODAY THAT AN IDENTICAL ENHANCEMENT OF GRADE PAY SHOULD BE RECOMMENDED FOR HSG-II/BCR [FROM 4200 TO 4600/-] AND HSG-I [FROM 4600 TO 4800/-] & FOR GROUP 'B' FROM 4800 TO 5400/- TO PROTECT THE HORIZONTAL AND VERTICAL RELATIVITY BETWEEN HSG-II/BCR/HSG-I AND IPOs/ASPOs.

Sub: Modification of Grade Pay to HSG-I and HSG-II/BCR Officials on par with ASPOs and IPOs to maintain pre-6th CPC horizontal and vertical relativity – reg.

This Federation draws your kind attention to the orders of the MOF F.No.1/1/2008-IC Dated 13.11.2009 revising the Grade Pay of 4200/- into 4600/- for the holders' of pre-revised scale of 6500-10500. We also draw your kind attention the positive stand taken by the Department of Posts to recommend similar hike in Grade Pay to IPOs with consequential further enhancement of GP to ASPOS and Group B. In this background, this Federation seeks an identical enhancement of GP of HSG-II/BCR with consequential further enhancement of GP of HSG-I and Group 'B' on the following grounds:

  1. 6th CPC recommended the PB-2 scale of 8700-34800 with Grade Pay 4200/- to HSG-II/BCR by amalgamating erstwhile 5000-8000; 5500-9000; 6500-10500 pay scales. Therefore w.e.f. 1.1.2006 the HSG-II/BCR officials are placed on the 8700-34800 Pay Band 2 with GP 4200/- on par with the IPOs who were also placed in the same PB-2 with GP 4200/-. This maintains the pre-6th CPC horizontal and vertical relativity of these cadres.
  2. 6th CPC recommended the PB-2 scale of 8700-34800 with Grade Pay 4600- to HSG-I through its recommendation vide Para 7.6.15 and the same had been accepted and implemented by the Government also. Thus the HSG-I officials are placed on par with the ASPOs in the same pre-revised scale of 7450-11500 w.e.f. 1.1.2006. This maintains the pre-6th CPC horizontal and vertical relativity of these cadres.
  3. Therefore the positive decision of the Department of Posts to recommend enhancement of IPOs Grade Pay to 4600/- on the analogy of the placement of IPOs in merged scale of 6500-10500 w.e.f. 1.1.2006 should be ipso facto be made applicable to the HSG-II/BCR who are placed in the same amalgamated pay scale with Grade Pay 4200/-.
  4. The Grade Pay of HSG-I is therefore consequently to be enhanced as 4800/- on the same lines of the Grade Pay of ASPOs since both HSG-I and ASPOS are on identically placed pay scales both before and after the 6th CPC.
  5. The Grade Pay of Group B is therefore consequently to be enhanced to Grade Pay 5400/- since both the HSG-I and ASPOs are promoted to Group B through examinations and Seniority –cum-fitness.
  6. The absence of a similar and identical hike in Grade Pay of HSG-II/BCR and HSG-I would disturb the existing pre-6th CPC and 6th CPC recommended horizontal and vertical relativity between these cadres and the cadres of IPOs/ASPOs over and the above the already disturbed relativity in comparison to the pre-5th CPC pay scales.

This Federation therefore urges upon you to kindly recommend to MOF a similar hike in Grade Pay to HSG-II/BCR; HSG-I cadres also to maintain at least the existing horizontal and vertical relativity between the cadres of IPOs with the HSG-II/BCR and between the cadres of ASPOs and HSG-I. We would highly appreciate your early action in this important issue.

Latest News from General Secretary regarding supply of Laptops to Sub Divisions and Revision of Grade Pay to IP/ASP/SP

Directorate is in the process of supplying laptops to Sub Divisional Heads. Directorate vide letter dated 19.01.10 has issued direction to Circles for selection of Vendors and for Placing orders for supply of Laptop to Sub Division.

Exercise for selection of Venders will be complted by 25.01.10 and it is hoped that orders will be plaed in February 2010.

File regarding grant of Grade Pay to IPs/ASPs/SPs is with Finance Ministry and the case is being perused by the Association.

ON 20.01.2010 AT ALL LEVELS
The metting of the Central Working Committee of GDS Union had called upon all Circle/Divisional/Branch Secretaries of AIPEDEU to stage intensive demonstration/Hunger fast on 20-1-2010 at all levels and to pass a suitable resolution. The Circle/Divisional/Branch Secretaries to send Telegrams / Savingrams to the Hon'ble Minister for Communications & IT, Minister of State for Communications & IT expressing their strong resentment on the GDS Committee implementation.
The Orders of the Department that tightens the work norms of the GDS BPMs is a big blow to the BPMs. If 20,000 cash handling is treated as 1 Point then most of the GDS BPMs will not get higher TRCA slabs. Even maintaining the present Second TRCA Slab will become a difficult task for many. The orders of fixing tightened norms unilaterally by the Department is most unjustified. All objections by GDS Unions and Federations to the retrograde recommendation of Nataraja Murti Committee recommendations have been ignored by DoP.
NFPE ENDORSES THE CALL OF THE GDS UNION CWC AND CALLS UPON ALL REGULAR EMPLOYEES DIVISIONAL AND BRANCH UNIONS TO EXTEND TOTAL SOLIDARITY TO THE GDS UNION IN SUCCESSFULLY ORGANISING THE PROGRAMME OF ACTION ON 20/01/2010.

Effect on modification/expuction of adverse remarks in the ACRs and up/down gradation of overall grading in the ACRs prior to 2008-09

Dear Comrades,
DOPT issued an order on 14/05/2009 regarding Annual Confidential Reports(ACR). By this order ACRs have been changed to APAR(Annual Performance Appraisal Report) and The full APAR including the overall grade and assessment of integrity shall becommunicated to the concerned officer after the Report is complete with the remarks of the Reviewing Officer and the Accepting Authority wherever such system is in vogue.Where Government servant has only one supervisory level above him as in the case of personal staff attached to officers, such communication shall be made after the reporting officer has completed the performance assessment.It is also mentioned that "The new system of communicating the entries in the APAR shall be made applicable prospectively only with effect from the reporting period 2008-09 which is to be initiated after 1st April 2009".The concerned officer shall be given the opportunity to make any representation against the entries and the final grading given in the Report within a period of fifteen days from
the date of receipt of the entries in the APAR. The representation shall be restricted to the specific factual observations contained in the report leading to assessment of the officer in terms of attributes, work output etc. While communicating the entries, it shall be made clear that in case no representation is received within the fifteen days, it shall be deemed that he/she has no representation to make. If the concerned APAR Section does not receive any information from the concerned officer on or before fifteen days from the date of disclosure, the APAR will be treated as final.
Now a clarification regarding the fate of earlier ACRs i.e.Prior to 2008 has been issued vide DOPT Memo No.21011/1/2005-Estt.(A) dated 06/01/2010.
Prior to that only adverse remarks in the ACR were required to be communicated for representation, if any. The then existing instructions further provided that the overall grading in the ACR should remain unchanged even after modification or expunction of the entire adverse remarks. It was left to the DPC to re-determine the overall grading if it considered that the expunction of such adverse remarks had so altered the quality of the ACR. The matter has been further considered and it has been decided that in those cases where the reckonable ACRs prior to the reporting period 2008-09 are to be considered in a future DPC on which the
adverse remarks of Reporting I Reviewing / Accepting Authorities have been expunged or modified by the Competent Authority, the "overall grading" in the ACR be kept blank for appropriate re-grading by the DPCs. The existing grading shall be blocked in such cases. It has also been decided that where the authority has upgraded / downgraded the overall grading without giving sufficient reasons, the DPC shall treat such an exercise as non-estlinvalid. General terms, such as "I agree or disagree with the Reporting Officer /Reviewing Officer" used by the Reviewing I Accepting Authority shall not be construed as sufficient reason for upgrading / downgrading the overall grading given by the Reporting Authority 1 Reviewing Authority. The proposals for the DPC where ACRs upto the reporting period 2007-08 will be taken into account should specifically bring out these guidelines.

Delhi CAT Judgement issued in respect of implementation of ACP

Dear Comrades,
On 23/12/2009 Justice V.K.Bali and Dr.Ramesh Chandra Panda of Delhi CAT while disposing the OA No.1604/2009 of R.P.Singh V/S Govt. of NCT of Delhi it is clearly mentined that "We need not refer to the case law on the pont as that would unnecessarily burden the judgement. However, it is by now a settled proposition of law that promotion of an employee cannot be stalled by putting his case in sealed cover unless, if the employee is facing a departmental enquiry, charge has been framed by the concerned authority, or if he is facing a criminal case, charge has been framed by the criminal court.We find no justification whatsoever for the respondents to have kept the case of the applicant in sealed cover."

Hon'ble Minister of Communications as well as Minister of State have cleared the crucial file regarding Merger of Accounts cadres of P & T, with clear cut instructions to all concerned Authority to comply with them in respect of the following three items:

1. All information sought by the Steering Group for Merger may be supplied by Officers of any rank in the Departments of Posts & Telecom

2. All promoted officials (465 waitlisted officials) may be relieved within Three Days time enabling them to assume charge and

3. Gazette Notification issued by the DOT to be implemented true to its letter and spirit.

Now the position is specific and categorical. Now, it has become our duty to give final touch to this hard won product of struggle by accepting the Provisional offer of promotion immediately and ready to undergo the proposed Training/Promotion.

It is, therefore, requested that all qualified officials may approach their concerned CCA, DOT and accept the offer of Promotion as per the Pro forma enclosed therein. This need not be confused with the question of Relieving order to be issued by DOP which will follow soon.
As per the Promotional Orders issued, even those officials who have earlier passed IPO exam and jointed as IPO or promoted ASP also are included. Therefore there is no problem for them too appear before the Controller in DOT in order to accept the promotional offer.

The undersigned is directed to say that issue of enhancement of the present limit of withdrawal without sanction of Account Office by EDSO/BO was under consideration of this Directorate from some time. This limit was last enhanced from Rs.500/- to Rs.2,000/- vide this office letter of even number dated 06-12-2001 and 12-12-2001 (SB order No.16/2001 and 18/2001). After careful consideration of the requests received, views of Circles and devaluation of rupee, it has been decided to enhance the present limit of withdrawal from Rs.2,000/- to Rs.5,000/- w.e.f. 15-12-2009.

2. It is requested that these changes may be brought to the notice of all post offices immediately for information, guidance and necessary action.

Sub: Revision of Norm for cash handling for work load assessment of Branch Postmaster.

I am directed to invite your kind attention to Para 2(b) of Directorate letter No.14-6/87-PAP dated 15.7.87, wherein the norms for fixation of the work load of the Branch Postmaster in Point system was communicated.

2. As per the above letter, the norm for cash transactions was fixed as " 1 Point for every Rs.1000 cash transactions in a month".

3. The Department has undertaken a work study for fixing the norms for cash handling by the Branch Postmasters. The IWSU of the Directorate has recommended for fixing the norms for cash handling by Branch Postmasters as Rs.20000/- per month for earning one point of work load. The Competent authority in consultation with Integrated Finance Wing after careful examination, has accepted the recommendations of the internal Work Study Unit of the Department. Consequently, the existing norm for cash handling for the Branch Postmasters is revised as " 1 Point for every Rs.20000/- cash transactions in a month" in supersession of the earlier order communicated vide letter No.14-6/87-PAP dated 15.7.87.

4. The cash handled on account of Money Order issue/payment, Savings Bank/RD deposits/withdrawals, RPLI collections/Bill collection and Bill Payments will constitute the items of cash handling. The remittances received from Account Office or sent to Account Office shall be excluded while computing the cash handling.

5. The above revised norm will apply with immediate effect.

6. The Heads of the Circles will please bring the contents of this letter to the notice of all concerned and ensure scrupulous observance of the revised norm.

Review of Scheme for compassionate appointment in the light of the 6th CPC recommendations

Dear Comrades,
Ministry of Personnel, Public Grievances and Pensions,DOPT issued order vide Memo No.F.No.14014/2/2009-Estt(D) dated 11/12/2009 in partial modification of the its Memo No.14014/6/94-Estt(D) dated 09/10/1998 that "In execptional circumstances Government may consider recruiting persons not immediately meeting the minimum qualification prescribed under the recruitment rules.The emoluments of these trainees, during the period of their training and before they are absorbed in the Government as employee, will be governed by the minimum of the -1S pay band of Rs.4440-7440 without any grade pay. In addition, they will be granted all applicable allowances like DA,HRA,and TA at the admissible rates. The same should be calculated on the minimm of -1S pay band without any grade pay. The period spent in the -1S payband by the future rcruits will not be counted as service for any purpose as their regular service will start only after they are placed in the payband PB-1 of Rs.5200-20200 along with grade pay of Rs.1800.

EXISTING INCUMBENT BPMs SHOULD BE PLACED IN THE REPLACEMENT TRCA SLABS CORRESPONDING TO THE PRE-REVISED TRCA

NEW TRCA SLAB CORRESPONDING TO 87.5 POINTS; 112.5 POINTS; & 125 POINTS HAS TO BE ASSESSED AFRESH WITH REFERENCE TO THE WORKLOAD

THE WORKLOAD ASSESSMENT WILL NATURALLY BE MADE AS PER THE ORDERS OF DIRECTORATE DATED 15/12/2009 STIPULATING 20,000/- CASH HANDLING IN A MONTH IS 1 POINT – THIS WILL REDUCE THE POINTS OF WORKLOAD IN MANY PLACES

THOSE WHO ARE IN PLACES WITH 75 POINTS AND GOT EQUIVALENT TRCA SLAB OF Rs. 2745-50-4245 AND THOSE WHO ARE AT 100 POINTS AND GOT THE TRCA SLAB OF 3660-70-5760 WILL NOT FACE ANY REDUCTION OF WAGES. BUT IF THOSE WHO ARE ASSESSED WITH BELOW 100 POINTS ARE PLACED IN 3200-60-5000 SLAB, THEY WILL FACE REDUCTION OF WAGES. IF SOME ARE ASSESSED WITH 112.5 OR 125 POINTS, THEY WILL GET THE HIGHER SLAB OF 4115-75-6365 AND 4575-85-7125. HOWEVER, WITH THE HARSH REVISION OF NORMS FOR CASH HANDLING AS PER 15/12/2009 ORDERS, IT IS AFRAID THAT WORKLOAD WILL BE ASSESSES LESS ONLY.

AIPEDEU CHQ HAS ALREADY WRITTEN TO DEPARTMENT OPPOSING THE ARBITRARY FIXATION OF NORMS @ 20,000/- CASH FOR 1 POINT. IT HAS ALSO OPPOSED THE EXCLUSION OF CASH REMITTANCES WITH THE ACCOUNT OFFICES FROM COMPUTING POINTS OF WORK LOAD. NFPE ALSO OPPOSES THE UNILATERAL FIXATION OF WORK NORMS FOR CASH HANDLING WITHOUT ANY DISCUSSION WITH THE GDS UNION OR BY IGNORING THE VIEW POINTS OF GDS UNION AND FEDERATIONS BEFORE THE GOPINATH COMMITTEE ON THIS ISSUE.

NFPE ENDORSES THE CALL GIVEN BY THE GDS UNION CWC MEETING HELD AT JAMNAGAR FOR:

  1. Holding of divisional level conventions in December 2009.
  2. Intensive demonstration/Hunger fast on 20-1-2010 at all levels.
  3. Holding of State level conventions in January – February 2010.
  4. National level Convention / Conference in February – March 2010.

Sub: Revision of Norm for cash handling for work load assessment of Branch Postmaster.
I am directed to invite your kind attention to Para 2(b) of Directorate letter No.14-6/87-PAP dated 15.7.87, wherein the norms for fixation of the work load of the Branch Postmaster in Point system was communicated.
2. As per the above letter,, the norm for cash transactions was fixed as " 1 Point for every Rs.1000 cash transactions in a month".
3. The Department has undertaken a work study for fixing the norms for cash handling by the Branch Postmasters. The IWSU of the Directorate has recommended for fixing the norms for cash handling by Branch Postmasters as Rs.20000/- per month for earning one point of work load. The Competent authority in consultation with Integrated Finance Wing after careful examination, has accepted the recommendations of the internal Work Study Unit of the Department. Consequently, the existing norm for cash handling for the Branch Postmasters is revised as " 1 Point for every Rs.20000/- cash transactions in a month" in supersession of the earlier order communicated vide letter No.14-6/87-PAP dated 15.7.87.
4. The cash handled on account of Money Order issue/payment, Savings Bank/RS deposits/withdrawals, RPLI collections/Bill collection and Bill Payments will constitute the items of cash handling. The remittances received from Account Office or sent to Account Office shall be excluded while computing the cash handling.
5. The above revised norm will apply with immediate effect.
6. The Heads of the Circles will please bring the contents of this letter to the notice of all concerned and ensure scrupulous observance of the revised norm.

Sub: Request for causing orders for reliving AAO promotees before 30/12/2009 – regarding.

Madam,

Kindly recall to your mind the discussions we had with you during the informal meeting granted by you on 17th December, 2009 about causing at least adhoc promotion to JAO waitlisted candidates as AAOs before 31/12/2009 to save huge monetary loss and delay in future promotional benefits to them.

The DoT has now issued orders vide No.27-7/2009 – SEA II dated 21/12/2009 offering provisional appointment in the cadre of AAOs to 465 waitlisted JAO qualified officials of Postal Department. These officials are given the chance of promotion w.e.f. 30/12/2009 and this will help all these promotees to gain their promotion immediately as well as saving their next increment on 1/7/2010 besides will go into reckoning for their further promotion based upon the cut off date 31st December.

This Federation reiterates that pending a final decision on cadre controlling authority by the Government of India, orders may kindly be caused to all circles to relieve the officials before 30/12/2009 to take charge as provisionally appointed AAO and then undergo training. We also would like to emphasis that any delay in their joining before 30/12/2009 would bring out heavy financial loss to all these officials.

This Federation therefore once again requests you to take a judicial view on this matter to ensure the relief of all the officials offered provisional promotion as AAOs before 30/12/2009.

The Non-Matriculate Group D employees promoted to Postmen Cadre or PA/SA Cadre on or after 1.1.2006 but before the implementation of 6th CPC pay scales are being denied 1800/- GP from 1.1.2006 for the duration of their Group D employment on the grounds that they were not being imparted with the required training. No action is also being taken in such cases to impart the same training as like other non-matriculate Group D staff.

This Federation therefore requests your kind intervention to cause to issue instructions to arrange for imparting the same training to such promoted non-matriculate officials also and grant 1800/- GP from 1.1.2006 to their date of promotion.

This Federation would highly appreciate your early action.

OFFICE MEMORANDUM

Subject: Posting of husband and wife at the same station.

In view of the utmost importance attached to the enhancement of women's status in all walks of life and to enable them to lead a normal family

life as also to ensure the education and welfare of the ·children, guidelines were issued by DOP&T in O.M No. 28034/7/86-Estt.(A) dated 3.4.86 and No.28034/2/97-Estt.(A) dated 12.6.97 for posting of husband and wife who are in Government service, at the same station. Department had on 23.8.2004 issued instructions to all Mins.lDeptts. to follow the above guidelines in letter and spirit.

2. In the context of the need to make concerted efforts to increase representation of women in Central Government jobs, these guidelines have

been reviewed to see whether the instructions could be made mandatory. It has been decided that when both spouses are in same Central Service or working in same Deptt. and if posts are available, they may mandatorily be posted at the same station. It is also necessary to make the provisions at Paras 3(iv) and (vi) of the a.M. dated 3.4.86 stronger as it is not always necessary that the service to which the spouse with longer service belongs has adequate number of posts and posting to the nearest station by either of the Department may become necessary.

3. On the basis of the 6

th CPC Report, Govt. servants have already been allowed the facility of Child Care Leave which is admissible till the children attain 18 years of age. On similar lines, provisions of a.M. dated 12.6.97 have been amended.

4. The onsolidated guidelines will now be as follows:

(i) Where the spouses belong to the same All India Service or two of the All India Services, namely lAS, IPS and Indian Forest Service (Group 'A');

The spouse may be transferred to the same cadre by providing for a cadre transfer of one spouse to the Cadre of the other

spouse, on the request of the member of service subject to the member of service not being posted under this process to

his/her home cadre. Postings within the Cadre will, of course, fall within the purview of the State Govt.

(ii) Where one spouse belongs to one of the All India Services and the other spouse belongs' to one of the Central Services:-

The cadre controlling authority of the Central Service may post the officer to the station or if there is no post in that station, to the State where the other spouse belonging to the All India service is posted.

(iii) Where the spouses belong to the same Central Service:

The Cadre controlling authority may post the spouses to the same station.

(iv) Where the spouse belongs to one Central Service and the other spouse belongs to another Central Service:-

The spouse with the longer service at a station may apply to his/her appropriate cadre controlling authority and the said

authority may post the said officer to the station or if there is no post in that station to the nearest station where the post exists. In case that authority, after consideration of the request, is not in a position to accede to the request, on the basis of non-availability of vacant post, the spouse with lesser service may apply to the appropriate cadre authority accordingly, and that authority will consider such requests for posting the said officer to the station or if there is no post in that station to the nearest station where the post exists.

(v) Where one spouse belongs to an All India Service and the other spouse belongs to a Public Sector Undertaking:

The spouse employed under the Public Sector Undertaking may apply to the competent authority and said authority may

post the said officer to the station, or if there is no post under the PSU in that station, to the State where the other spouse is

posted.

(vi) Where one spouse belongs to a Central Service and the other spouse belongs to a PSU:-

The spouse employed under the PSU 'may apply to the competent authority and the said authority may post the officer to the station or if there is no post under the PSU in that station, to the station nearest to the station where the other spouse is posted. If, however, the request cannot be granted because the PSU has no post in the said station, then the spouse belonging to the Central Service may apply to the appropriate cadre controlling authority and the said authority may post the said officer to the station or if there is no post in that station, to the station nearest to the station where the spouse employed under PSU is posted.

(vii) Where one spouse is employed under the Central Govt. and the other spouse is employed under the state Govt.:-

The spouse employed under the Central Govt. may apply to the competent authority and the competent authority may post the said officer to the station or if there is no post in that station to the State where the other spouse is posted.

(viii) "The husband

& wife, if working in the same Department and if the required level of post is available, should invariably be posted together in order to enable them to lead a normal family life and look after the welfare of their children especially till the children attain 18 years of age. This will not apply on appointment under the central Staffing Scheme. Where only wife is a Govt. servant, the above concessions would be applicable to the Govt. servant.

5. Complaints are sometimes received that even if posts are available in the station of posting of the spouse, the administrative authorities do not

accommodate the employees citing administrative reasons. In all such cases, the cadre controlling authority should strive to post the employee at the station of the spouse and in case of inability to do so, specific reasons, therefor, may be communicated to the employee.

6. Although, normal channels of representations/complaints redressal mechanism exist in the Min.lDeptts., added safeguards to prevent noncompliance may be provided by ensuring that the complaints against nonadherence to the instructions are be decided by the authorities at least one level above the authorities which took the original decision when they are below the level of secretary to the Govt. of India/Head of the PSU concerned

and all such representations are considered and disposed off in time bound manner.
